1. Acceptance of Terms
Welcome to GGPoker. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Player", or "You") and GGPoker ("Company", "We", "Us", or "Our") governing your access to and use of our website, downloadable client software, mobile applications, and any related services (collectively, the "Platform"). By registering an account, downloading our software, or participating in any real-money or play-money games on our Platform, you explicitly acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any provision of these Terms, you must immediately cease all use of the Platform and uninstall any related software.
2. Eligibility and Jurisdiction
To access and use the real-money features of the Platform, you must be at least twenty-one (21) years of age, or the legal age of majority in your jurisdiction of residence, whichever is higher. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into binding contracts. Online gambling may not be legal in some jurisdictions. We do not intend for the Platform to be used by persons in countries where such activities are illegal. It is your sole and exclusive responsibility to ensure that your use of the Platform fully complies with all applicable local, state, national, and international laws and regulations in your jurisdiction.
3. Account Registration and Security
You are permitted to open and maintain only one (1) account on the Platform. The creation of multiple accounts by a single user is strictly prohibited and is grounds for immediate account suspension and the forfeiture of all funds held within those accounts. During the registration process, you must provide accurate, current, and complete information, including your full legal name, date of birth, residential address, and a valid email address. You agree to update this information promptly if it changes.
You are entirely responsible for maintaining the confidentiality of your account login credentials, including your username and password. You agree not to disclose this information to any third party and to take all reasonable steps to prevent unauthorized access to your account. The Company is not liable for any losses or damages resulting from unauthorized access to your account due to your failure to safeguard your credentials.
4. Prohibited Activities and Fair Play
GGPoker is committed to maintaining a fair, secure, and enjoyable gaming environment. To uphold the integrity of the Platform, the following activities are strictly prohibited:
- Collusion: Working together with one or more other players to gain an unfair advantage over others at the table.
- Chip Dumping: Intentionally losing hands to transfer chips to another player's account.
- Use of Bots and RTA: The use of artificial intelligence, automated playing software ("bots"), or Real-Time Assistance (RTA) tools that provide decision-making advice during live play.
- Ghosting: Allowing a third party to play on your account or providing real-time advice to another player while they are playing.
- Data Mining: The use of software to extract hand histories or player profiles for the purpose of gaining an unfair advantage.
We employ sophisticated monitoring tools to detect prohibited activities. If we reasonably suspect that you have engaged in any form of cheating or fraud, we reserve the right to immediately suspend or permanently close your account, confiscate all funds, and take appropriate legal action.
5. Financial Transactions: Deposits and Withdrawals
You may deposit funds into your GGPoker account using only payment methods registered in your own name. The use of corporate cards, third-party payment methods, or funds obtained from illegal activities is strictly prohibited. We reserve the right to request documentation to verify the source of your funds and the ownership of your payment methods in accordance with our Anti-Money Laundering (AML) obligations.
Withdrawals will generally be processed back to the original method used for deposits, up to the deposited amount. Any remaining balance may be withdrawn to an alternative verified payment method. We aim to process all withdrawal requests promptly; however, processing times may vary depending on the payment provider and the completion of necessary security checks. The Company reserves the right to charge administrative fees for excessive or abusive withdrawal requests.
6. Bonuses and Promotions
From time to time, GGPoker may offer bonuses, promotional credits, tournament tickets, and other rewards. All such offers are subject to these Terms as well as specific promotional terms and conditions. Bonuses are generally non-transferable and cannot be withdrawn immediately. They are subject to wagering requirements, play-through conditions, and expiration dates. The Company reserves the right to withhold, cancel, or void any bonus and associated winnings if we suspect promotional abuse, fraud, or a breach of the specific terms governing the offer.
7. Intellectual Property Rights
The Platform, including all underlying software, algorithms, databases, website design, text, graphics, audio, video, trademarks, logos, and trade names, is the exclusive property of GGPoker or its licensors and is protected by international copyright, trademark, and intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the software solely for the purpose of playing games on the Platform in accordance with these Terms. You may not copy, modify, distribute, reverse engineer, decompile, or disassemble any part of the Platform.
8. Responsible Gaming
GGPoker encourages you to play responsibly. We provide various tools to help you manage your gaming activity, including the ability to set daily, weekly, or monthly deposit limits, session time limits, and self-exclusion periods. If you choose to self-exclude, your account will be locked for the specified duration, and you will not be able to access the Platform or receive marketing materials. While we will make reasonable efforts to enforce self-exclusion policies, you acknowledge that we are not liable if you circumvent these measures by opening a new account under false details.
9. Limitation of Liability and Disclaimers
The Platform and all services are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Platform will be uninterrupted, error-free, completely secure, or free from viruses or other harmful components.
To the fullest extent permitted by applicable law, GGPoker, its directors, officers, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or loss of goodwill, arising out of or in connection with your use or inability to use the Platform, even if we have been advised of the possibility of such damages. In no event shall our total liability to you for all damages exceed the amount of funds currently held in your account.
10. Indemnification
You agree to indemnify, defend, and hold harmless GGPoker, its parent companies, subsidiaries, affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from your breach of these Terms, your violation of any law or the rights of a third party, or your use or misuse of the Platform.
11. Modifications to the Terms
We reserve the right to modify, amend, or update these Terms at any time and at our sole discretion. Any changes will be published on this page, and the "Last Updated" date at the top will be revised accordingly. It is your responsibility to review these Terms periodically. Your continued use of the Platform following the posting of any changes constitutes your acceptance of the revised Terms. If a significant change is made, we may notify you via email or a prominent notice upon logging into the software.
12. Dispute Resolution and Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the operating entity of GGPoker is registered, without regard to its conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be resolved through amicable negotiations. If a resolution cannot be reached, the dispute shall be submitted to the exclusive jurisdiction of the competent courts in the aforementioned jurisdiction. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against the Company.
